2.3 Works excluded from protection

If a work does not fulfil the conditions specified in Art. 2 para. 1 CopA, i.e. if it is not an intellectual creation with an individual character, then the work is not protected by copyright. In the case of some works, it is not even necessary to check these conditions. Copyright protection is already ruled out by law in these cases. Pursuant to Art. 5 para. 1 CopA, such works include:

  • acts, ordinances, international treaties and other official enactments;
  • means of payment;
  • decisions, minutes and reports issued by authorities and public administrations;
  • patent specifications and published patent applications.
